The Bill (Reg. No. 2136), submitted by People´s Deputy O. Zarubinsky, proposes to introduce to the Code on Administrative Infringements of Ukraine new Article 185-13, in accordance with which "Disparagement of Ukrainian nation, i.e. any public actions aimed at humiliation of national traditional cultural, moral and ethical values, ethnical originality and historical memories of Ukrainian people, that undermine its authority among other peoples and discredit its self-esteem - shall be punishable by a fine of 50 to 150 untaxed minimum incomes of citizen.

 

Actions, provided by Part I of this Article, repeated by the same person shall be punishable by a fine of 150 to 250 untaxed minimum incomes of citizen ".

 

Taking into account special status of public authority and local governments officials, as People´s representatives, for the development of State, the Bill´s author also suggests to impose criminal liability on them for disparagement of Ukrainian nation, by introduction of new Article 337-1 to the Criminal Code of Ukraine.

 

Furthermore, amendments to the Criminal Procedure Code of Ukraine suggest that prejudicial investigation in criminal cases concerning the disparagement of Ukrainian nation, analogously to cases concerning outrage upon state symbols of Ukraine, is carried out by investigators of the Office of Public Prosecutor.

 

In People´s Deputies opinion, adoption of this Law "will contribute to decrease of populist declarations, which demoralize and fragment Ukrainian people, and correspondingly create favourable conditions for forming of State-supportive public opinion".
